Official Contest Rules
No Purchase Necessary to Enter or Win.
Many Will Enter, Few Will Win.
Eligibility: Contest open to "Nominators" (person who submits an entry) and "Nominees" (subject matter of the submitted entry) who are legal residents of the 50 United States including the District of Columbia and are eleven (11) years of age or older as of date of entry. The Nominee must also be someone with whom the Nominator is personally acquainted. A minor Nominator/Nominee must have a parent's or legal guardian's permission to participate. Officers, directors, employees, representatives and agents of Sara Lee Food & Beverage, a division of Sara Lee Corporation (hereafter, "Sponsor"), Snap Marketing (hereafter, "Administrator"), Project Support Team, Inc., and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, and advertising and promotion agencies (collectively, the "Released Parties"), and each such individual's immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win a prize. Void where prohibited or restricted by law. All applicable federal, state and local laws and regulations apply.
To Enter: Nominators must attend a Jimmy Dean "Happy Breakfast" event ("Event"), taking place at designated locations between 9/1/07 and 11/18/07 ("Entry Period"), complete and submit an Official Entry Form, while supplies last, during the event start and finish times, and record an original video presentation up to one (1) minute in length describing why a certain person in Nominator's life deserves a happy breakfast ("Theme") (collectively "Entry"). Limit one (1) Entry per Nominator. Entries will be recorded on a first come, first serve basis and Sponsor does not guarantee that every individual who wants to submit an Entry will have the opportunity to do so. Minors must be accompanied to Event by a parent or legal guardian who must complete the Official Entry Form on the minor's behalf and provide parental consent for the minor's participation in the Contest. All Entries become the property of Sponsor and none will be returned. The twelve (12) Event cities are listed below:
For a list of up to twenty-four (24) locations where Events will be held in the twelve (12) cities, and the applicable times you may enter at each, visit www.happybreakfast.com. Representatives designated by Sponsor will record the nomination video using equipment provided by Sponsor. No professional or pre-recorded videos will be accepted. Nominators will only be provided one opportunity to record a nomination video. No one other than Nominator may appear in video, other than in the case of Nominators who have specific needs, including handicaps or are minors. To be eligible, Entry cannot have been previously published or submitted in any competition and must be: in English; true and verifiable, and must be your original creation. Modification of an existing work does not qualify as an original creation. The Nominee (subject matter of Entry) may not be yourself and must not be deceased. In the event of non-compliance with any of the terms of these rules, Entry will be void and disqualified. Sponsor shall have the right, at its discretion, to disqualify any Entries that Sponsor deems to be offensive, immoral, obscene, defamatory, profane, not in keeping with Sponsor's image or otherwise not in good taste. Other than for prize notification, neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any Nominator or Nominee regarding this Contest or acknowledge any Entry not meeting all entry requirements stated herein and any such Entry will be disqualified. Released Parties are not responsible for incomplete, lost, late, damaged, stolen, illegible, garbled or inaccurate Entries (or any component thereof) or votes, lost or mistabulated votes or for inaccurate Entry or Contest-related information provided by Sponsor or for interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone line or transmission problems or technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware) or other errors or malfunctions of any kind whether caused by equipment, programming used in this Contest, mechanical, electronic or human error or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing or judging of Entries, the recording of nomination videos, the tabulating of votes, the announcement of the prizes, the cancellation or postponement of any Event or in any Contest-related materials.
Judging:
Event Prize Judging: Based on the following criteria, 5 days following each Event, the qualified judges will select, from among all eligible Entries received at each respective Event, one (1) Entry as an Event Prize winner, for a total of up to twenty-four (24) Event Prize winning Entries (24 Nominators and 24 Nominees) for the entire Contest. Eligible Entries will be judged based on the following criteria: 1) Creative Expression: 0-30 points; 2) Level of Impact of Nominee's Actions Described in Entry: 0-30 points; and 3) Entry's Relevance to Theme: 0-40 points. In the event of a tie at any Event, such tied Entries will be re-judged at the respective Event based on Level of Impact of Nominee's Actions Described in Entry: 0-100 points. Selected Event Prize winners (Nominees and Nominators (and the parent or legal guardian of any minor Nominee or Nominator) will also be notified by telephone and/or overnight mail and/or regular mail. Prize awards are subject to verification of eligibility and compliance with the terms of these rules. Sponsor reserves the right to not select an Event Prize winner for any Event if, in its sole discretion, it does not receive any qualified Entries for such Event.
Semi-Finalist Judging: Based on the judging criteria outlined above, a panel of qualified independent judges determined by Sponsor will select five (5) "Semi-Finalist Nominees" on or about 12/3/07 from among the up to twenty-four (24) Event Prize winning Entries. Semi-Finalist Nominees (and, if eligible minors, their parents or legal guardians) will be notified on or about 12/5/07 by phone and regular mail. Judge's and Sponsor's decisions will be final and binding in all matters relating to this Contest. All five (5) potential Semi-Finalist Nominees and their respective Nominators (or the parent or legal guardian of any minor Nominee or Nominator) will be contacted by telephone and/or mail and will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within five (5) days of date of issuance of notification. Noncompliance with the foregoing, with these rules, any notification being returned as non-deliverable or Sponsor's inability to contact a potential Semi-Finalist Nominee and/or his/her respective Nominator (or the parent or legal guardian of any minor Nominee or Nominator) within three (3) days may result in disqualification and a runner-up Semi-Finalist Nominee being chosen at Sponsor's sole discretion.
Voting on the five (5) Semi-Finalist Nominees: From 12:00:00 noon Eastern Time ("ET") on 12/10/07 until 11:59:59 a.m. ET on 1/15/08 (the "Voting Period"), the Entries for the five (5) Semi-Finalist Nominees will be placed online at www.happybreakfast.com (the "Site") for public vote. To vote for the Semi-Finalist Nominee who voter feels best deserves a Happy Breakfast, voters must visit the Site during the Voting Period and submit his/her name, e-mail address, date of birth and the validation code as shown on the screen in the spaces indicated, judge the Entry of each Semi-Finalist Nominee, and click on the "Vote" button for the Nominee such voter would like to select, and, finally, click the "Submit " button. Voter's e-mail address must be an existing, valid address as determined by Sponsor. A voter must be a legal U.S. resident (excluding residents of Puerto Rico, U.S. territories and possessions) and be 13 years of age or older at time of vote submission. Limit one (1) online vote per person or e-mail address per calendar day throughout the Voting Period. A calendar day for the purpose of this Contest begins at 12:00:00 a.m. ET and ends at 11:59:59 p.m. ET, except for the first day of voting period, which will begin at 12:00:00 noon ET and the last day of voting period, which will end at 11:59:59 a.m. ET. By voting, voters consent to the use of their submitted e-mail address by Sponsor for the purpose of sending promotional e-mails to voters or to offer information on other offers or products or services. Voters may opt-out of receiving such e-mails at any time and doing so will have no impact on submitted vote. Information collected will be used in accordance with the Sponsor's privacy policy, available at www.happybreakfast.com. Sponsor reserves the right to edit or modify the Entries for the Semi-Finalist Nominees for posting on the Site as it deems necessary in its sole discretion and Nominee and Nominator (or the parent or legal guardian of any minor Nominee and Nominator) acknowledge and agree that Released Parties shall not be responsible for any alleged consequences of such editing (including any alleged loss of votes resulting therefrom) or for any Entry being used, edited or copied from the Site or otherwise misappropriated by third parties. Sponsor does not guarantee the appearance of any Semi-Finalist Entry on the Site and may refuse to make any Entry available on the Site for any reason as determined by Sponsor in its sole discretion. The use of any device to automate or impair the integrity of the voting process is prohibited and all such votes are void. The eligible votes received will be tallied and verified by 1/21/08, at which time the Semi-Finalist Nominee of the one (1) Entry receiving the most verified votes, as determined by Sponsor, will be declared the Grand Prize winner, subject to verification of eligibility and compliance with the terms of these rules. Grand Prize Winner shall be deemed the selected Nominee, and not the Nominator who submitted the winning Entry. In the event of a tie in the number of verified votes, Grand Prize winner will be selected by the judges from among the tied Entries based on Level of Impact of Nominee's Actions Described in Entry: 0-100 points. Potential Grand Prize winner (and the parent or legal guardian if Grand Prize winner is a minor) will be notified by telephone and/or overnight mail and/or regular mail and may be required to execute and return additional documentation required by and as specified by Sponsor. Noncompliance with the foregoing, with these rules, the return of any notification as undeliverable or Sponsor's inability to contact the potential Grand Prize winner (or the parent or legal guardian if Grand Prize winner is a minor) within fourteen (14) days may result in disqualification and the runner-up will be notified at Sponsor's sole discretion. If any winner is a minor, prize may, at Sponsor's discretion, be awarded in the name of the parent or legal guardian who will be required to fulfill all requirements imposed on winners set forth herein (and, if the Grand Prize, such minor winner must accompany parent or legal guardian on trip). Sponsor reserves the right to not award any prize or all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Sponsor reserves the right, in its sole discretion, to void suspect Entries and/or votes or to modify, cancel, terminate or suspend the online voting process should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Contest and, in the event of such cancellation, suspension or termination, at its discretion, select the Grand Prize winner from all valid, non-suspect votes received prior to such event. By participating, Nominators and Nominees (or the parent or legal guardian of any minor Nominee or Nominator) agree to abide by these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding.
Prizes:
Twenty-four (24) Nominator Event Prizes: For each Event Prize winning Nominator: A Jimmy Dean breakfast for one (1) person for one (1) month awarded in the form of four (4) full product coupons for free Jimmy Dean® products valued at up to five dollars ($5.00) each. Approximate Retail Value ("ARV") of each Nominator Event Prize = twenty dollars ($20.00). Limit one (1) Event Prize per person.
Twenty-four (24) Nominee Event Prizes: For each Event Prize winning Nominee: A Jimmy Dean breakfast for one (1) person for one (1) year, awarded in the form of fifty-two (52) full product coupons for free packages of Jimmy Dean® product valued at up to five dollars ($5.00) each. ARV of each Nominee Event Prize = two hundred sixty dollars ($260.00). Limit one (1) Event Prize per person.
One (1) Grand Prize; awarded to the Nominee (subject matter of Entry) of the Semi-Finalist Entry receiving the most votes during the Voting Period: A 5-day/4-night trip for up to four (4) to spend the Thanksgiving Day (November 27, 2008) holiday in New York City, NY. Trip consists of round trip coach air transportation from major U.S. gateway airport nearest winner's residence in the U.S. for four (4), standard hotel accommodations for four (4) and $2,000 spending money for winner only awarded in the form of a debit card. ARV of Grand Prize trip = $7,400. Actual value may vary depending upon location of winner's residence. Debit card is subject to the terms and conditions as specified by issuer. If winner resides within a 100 mile radius of New York City, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Travel and accommodation restrictions and other travel restrictions may apply. Grand Prize winner and guests must travel together on the same itinerary and are responsible for obtaining all required travel documents. If winner cannot travel on specified dates, winner will be disqualified and, at Sponsor's discretion, Sponsor will select runner-up as winner. All travel arrangements must be made through travel agent of Sponsor's selection on a carrier of Sponsor's choice. Prizes are awarded "as is" without any warranty or guarantee either express or implied by Sponsor. Certain restrictions on coupons and debit card may apply. All applicable federal, state and local taxes, if any, and any other costs and expenses associated with prize acceptance and use not specified herein as being awarded are the sole responsibility of the winners, including but not limited to, with respect to the Grand Prize, ground transportation, meals and gratuities. Total ARV of all prizes = $14,680. All prize details are at Sponsor's sole discretion.
Miscellaneous: No transfer, assignment, or substitution of prizes, or portion thereof, except by Sponsor who may substitute a prize, or portion thereof, with one of comparable or greater value, at its sole discretion. By entering, each Nominator (and the parent or legal guardian of any minor Nominator) warrants and represents that his/her Entry submitted does not defame or otherwise violate the rights of any third party and does not violate any federal, state or local laws or ordinances. Nominators (and the parent or legal guardian of any minor Nominator) further warrant and represent that (1) they have secured the requisite consent from any third party referenced in their Entry (including, but not limited to, the Nominee and any company or other third party trademarks or logos) and, if their Entry is a winner, agree to provide legal releases for the use of such reference in a form satisfactory to judges; (2) that Sponsor shall own the Entries (and all material embodied therein); and (3) that by entering, the Nominator (and the parent or legal guardian of any minor Nominator) irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the Entry including but not limited to all intellectual property rights; and (4) that Sponsor and its designees shall have, without limitation, the perpetual right worldwide to edit, adapt, modify, publish, exploit and use the Entries in any way and in any and all media for trade, advertising, promotional and/or other purposes (including, but not limited to, displaying Entry online at www.happybreakfast.com as stated above for public display and voting) as Sponsor and/or its designees may determine without further permission from; or notification or consideration to Nominators, Nominees, or any third parties. Nominators (and the parent or legal guardian of any minor Nominator) further agree that Entry (and all components thereof) will not be acknowledged or returned. Nominators and Nominees (and the parent or legal guardian of any minor Nominator or Nominee) agree that (1) Sponsor and its designees shall have the right and permission to use (unless prohibited by law) Nominator's and Nominee's name, voice, appearance, image, city and state of residence, photograph and/or likeness and Entry for advertising and/or promotional and/or trade and/or any other purpose in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission or notification to Nominators, Nominees or any third parties; and (2) the Released Parties shall have no liability and will be held harmless by Nominators for any liability, loss, injury or damage to participants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of Nominator's attendance at any Event (including travel to and from an Event), participation in this Contest, the use of any Entry the use or misuse of any prize (including any travel or activity related thereto) or any of the rights granted herein. By accepting prize, Nominees and Nominators (and the parent or legal guardian of any minor Nominee or Nominator) agree that Released Parties shall have no liability and will be held harmless for any liability, loss, injury or damage, due in whole or in part, directly or indirectly, by reason of Nominator's and/or Nominee's (as applicable) acceptance, possession, use or misuse of a prize and any travel or travel-related activity thereto (including, but not limited to, attendance at the parade and any activities) or participation in this Contest. Released Parties are not responsible for any inability of the winners to accept or use a prize and reserves the right, at its sole discretion, to disqualify or eliminate Nominees and Nominators and award prizes to the next Nominator and Nominee runner-up.

Twenty-four (24) Nominee Event Prizes: For each Event Prize winning Nominee: A Jimmy Dean breakfast for one (1) person for one (1) year, awarded in the form of fifty-two (52) full product coupons for free packages of Jimmy Dean® product valued at up to five dollars ($5.00) each. ARV of each Nominee Event Prize = two hundred sixty dollars ($260.00). Limit one (1) Event Prize per person.
One (1) Grand Prize; awarded to the Nominee (subject matter of Entry) of the Semi-Finalist Entry receiving the most votes during the Voting Period: A 5-day/4-night trip for up to four (4) to spend the Thanksgiving Day (November 27, 2008) holiday in New York City, NY. Trip consists of round trip coach air transportation from major U.S. gateway airport nearest winner's residence in the U.S. for four (4), standard hotel accommodations for four (4) and $2,000 spending money for winner only awarded in the form of a debit card. ARV of Grand Prize trip = $7,400. Actual value may vary depending upon location of winner's residence. Debit card is subject to the terms and conditions as specified by issuer. If winner resides within a 100 mile radius of New York City, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Travel and accommodation restrictions and other travel restrictions may apply. Grand Prize winner and guests must travel together on the same itinerary and are responsible for obtaining all required travel documents. If winner cannot travel on specified dates, winner will be disqualified and, at Sponsor's discretion, Sponsor will select runner-up as winner. All travel arrangements must be made through travel agent of Sponsor's selection on a carrier of Sponsor's choice. Prizes are awarded "as is" without any warranty or guarantee either express or implied by Sponsor. Certain restrictions on coupons and debit card may apply. All applicable federal, state and local taxes, if any, and any other costs and expenses associated with prize acceptance and use not specified herein as being awarded are the sole responsibility of the winners, including but not limited to, with respect to the Grand Prize, ground transportation, meals and gratuities. Total ARV of all prizes = $14,680. All prize details are at Sponsor's sole discretion.
Miscellaneous: No transfer, assignment, or substitution of prizes, or portion thereof, except by Sponsor who may substitute a prize, or portion thereof, with one of comparable or greater value, at its sole discretion. By entering, each Nominator (and the parent or legal guardian of any minor Nominator) warrants and represents that his/her Entry submitted does not defame or otherwise violate the rights of any third party and does not violate any federal, state or local laws or ordinances. Nominators (and the parent or legal guardian of any minor Nominator) further warrant and represent that (1) they have secured the requisite consent from any third party referenced in their Entry (including, but not limited to, the Nominee and any company or other third party trademarks or logos) and, if their Entry is a winner, agree to provide legal releases for the use of such reference in a form satisfactory to judges; (2) that Sponsor shall own the Entries (and all material embodied therein); and (3) that by entering, the Nominator (and the parent or legal guardian of any minor Nominator) irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the Entry including but not limited to all intellectual property rights; and (4) that Sponsor and its designees shall have, without limitation, the perpetual right worldwide to edit, adapt, modify, publish, exploit and use the Entries in any way and in any and all media for trade, advertising, promotional and/or other purposes (including, but not limited to, displaying Entry online at www.happybreakfast.com as stated above for public display and voting) as Sponsor and/or its designees may determine without further permission from; or notification or consideration to Nominators, Nominees, or any third parties. Nominators (and the parent or legal guardian of any minor Nominator) further agree that Entry (and all components thereof) will not be acknowledged or returned. Nominators and Nominees (and the parent or legal guardian of any minor Nominator or Nominee) agree that (1) Sponsor and its designees shall have the right and permission to use (unless prohibited by law) Nominator's and Nominee's name, voice, appearance, image, city and state of residence, photograph and/or likeness and Entry for advertising and/or promotional and/or trade and/or any other purpose in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission or notification to Nominators, Nominees or any third parties; and (2) the Released Parties shall have no liability and will be held harmless by Nominators for any liability, loss, injury or damage to participants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of Nominator's attendance at any Event (including travel to and from an Event), participation in this Contest, the use of any Entry the use or misuse of any prize (including any travel or activity related thereto) or any of the rights granted herein. By accepting prize, Nominees and Nominators (and the parent or legal guardian of any minor Nominee or Nominator) agree that Released Parties shall have no liability and will be held harmless for any liability, loss, injury or damage, due in whole or in part, directly or indirectly, by reason of Nominator's and/or Nominee's (as applicable) acceptance, possession, use or misuse of a prize and any travel or travel-related activity thereto (including, but not limited to, attendance at the parade and any activities) or participation in this Contest. Released Parties are not responsible for any inability of the winners to accept or use a prize and reserves the right, at its sole discretion, to disqualify or eliminate Nominees and Nominators and award prizes to the next Nominator and Nominee runner-up.
